Welcome to CourtShare. This Terms of Service ("Terms") is a legally binding contract between you ("User," "you") and Court Share LLC ("CourtShare," "we," "us," "our") that governs your access to and use of the CourtShare website, and any related services (collectively, the "Service").
By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
1. THE MOST IMPORTANT PART: KEY DISCLAIMERS
This Service is a simulation for entertainment purposes only. You must acknowledge and agree to the following before using CourtShare:
NO REAL MONEY OR MONETARY VALUE:
The virtual currency ("Court Coins") and virtual player "shares" ("Player Shares") are fictional and exist only within the Service. They have NO MONETARY VALUE, cannot be redeemed for cash, prizes, or anything of value, and cannot be sold, traded, or transferred outside of the Service.
NOT GAMBLING:
The Service is a game of skill. There is no entry fee or wager required to participate in the core gameplay. There is no prize of monetary value. It is not a platform for gambling, and any use of the Service for such purposes is strictly prohibited.
NOT INVESTMENT ADVICE:
CourtShare is not a financial market or investment platform. We are not a broker or financial institution. The Service provides a fictional simulation and does not offer any investment advice. All "trading" activity is for entertainment and educational purposes only.
NO AFFILIATION:
CourtShare is not sponsored by, endorsed by, or affiliated with the National Basketball Association (NBA), the National Basketball Players Association (NBPA), or any of their respective teams or players. All player names and associated data are used for identification and commentary purposes only under the principle of nominative fair use.
2. Eligibility & Account Registration
Age:
You must be at least 13 years old to use the Service. If you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and agreed to these Terms.
Account:
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to create only one account and to provide accurate information.
3. Virtual Items (Court Coins & Player Shares)
The Service includes virtual items, including "Court Coins" and "Player Shares." Your use of these is subject to the following rules:
Limited License:
Virtual Items are not your property. We grant you a limited, non-transferable, non-sublicensable, revocable license to use the Virtual Items within the Service.
No Value:
You acknowledge that these Virtual Items have no cash value and that we are not obligated to exchange them for anything of value.
Our Control:
We have the absolute right to manage, regulate, control, modify, or eliminate Virtual Items at our sole discretion, and we will have no liability to you or any third party for the exercise of such rights. Prices and availability of Player Shares may change without notice.
4. Acceptable Use Policy
You agree not to do any of the following while using the Service:
- Use bots, cheats, scripts, or any unauthorized third-party software to automate gameplay or exploit bugs.
- Engage in any activity that attempts to manipulate the price of Player Shares in a way that violates the spirit of the game.
- Sell, trade, or transfer your account or any Virtual Items to anyone for real money or any other consideration.
- Harass, threaten, or defraud other users.
- Violate any applicable law or regulation.
5. Intellectual Property
All rights, title, and interest in and to the Service (including the website, code, design, branding, and our proprietary pricing algorithm) are and will remain the exclusive property of Court Share LLC. You may not use the "CourtShare" name or any of our trademarks without our prior written permission.
6. Termination
We may suspend or terminate your access to the Service at any time, for any reason, without notice, especially if you violate these Terms. Upon termination, your license to use any Virtual Items will be revoked, and you will not be compensated for any loss.
7. Disclaimers and Limitation of Liability
"AS IS" SERVICE:
The Service is provided "AS IS," without warranty of any kind. We do not warrant that the Service will be uninterrupted, secure, or error-free.
LIMITATION OF LIABILITY:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STARRO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
8. Dispute Resolution, Governing Law, and Arbitration
Governing Law:
These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions.
MANDATORY ARBITRATION:
You agree that any dispute between you and Court Share LLC will be resolved by binding, individual arbitration and you waive your right to participate in a jury trial or in a class action lawsuit.
CLASS ACTION WAIVER:
You agree to only bring claims against us in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
9. General Terms
These Terms constitute the entire agreement between you and Court Share LLC. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
